Update of the information about the Permit for conducting business activity in the area of the TSEZ

The Management Board of Polimex-Mostostal S.A. informs that today the Companyreceived the Decision of the Minister of Economy dated 26 February 2010 on amendingthe Permit No. 171/ARP S.A./2008 for conducting business activity within the area of theTSEZ granted to Polimex-Mostostal S.A. on 23rd July 2008. In compliance with theDecision the time limits for meeting the conditions by Polimex-Mostostal S.A. that are setforth in the Permit have been changed.
In accordance with the received decision new conditions for conducting business activitywithin the area of the Tarnobrzeg Special Economic Zone EURO-PARK WISŁOSANhave been agreed.

1. Increase in employment which is at the level of 2,399 employees within the area ofSiedlce-based Subzone by hiring at least 350 new employees within the area of theTarnobrzeg Special Economic Zone TSEZ EURO-PARK WISŁOSAN by 31stMarch 2010 and maintaining the employment at the level not lower than 2,749employees within the Siedlce-based Subzone by 31st March 2015 – instead of 31stMarch 2014.
2. Incurring within the area of the Zone investment expenditure within the meaningof § 6 section 1 of the Ordinance of the Council of Ministers of 22 November 2006on the Tarnobrzeg Special Economic Zone (Dziennik Ustaw – Journal of Laws no.215, item 1581 as amended) in the amount not lower than 210,300,000.00 zlotysby 31st March 2011 – instead of 31st March 2010.
3. The Investment shall be completed by 31st March 2011 – instead of 31st March2010.

The above information constitutes a material change of the information submitted pursuantto Article 56 section 1 point 1 of the Act of 29 July 2005 on Public Offering andConditions Governing Introduction of Financial Instruments to Organised Trading Systemand on Public Companies. The current report including information on granting theCompany by Agencja Rozwoju Przemysłu S.A. in Warsaw the permit for conductingbusiness activity within the area of the Tarnobrzeg Special Economic Zone EURO-PARKWISŁOSAN was sent on 25th July 2008 and marked with no. 52/2008.
