Court decision on the opening of recovery proceedings against the Issuer’s subsidiary company.

Legal basis: Article 56 (1) (1) of the Act on public offering – confidential information

The Management Board of "Polimex-Mostostal" SA having its registered address in Warsaw at ul. Jana Pawła II  12 (hereinafter referred to as the ‘Issuer’) hereby informs that today they received information that in 19 April 2016 the District Court for Katowice Wschód in Katowice, X Commercial Division, made a decision on the opening of recovery proceedings against Przedsiębiorstwo Robót Inżynieryjno-Budowlanych Inż-Bud Sp. z o.o. (Limited Liability Company) having its registered office in Sosnowiec, a subsidiary company of the Issuer’s (hereinafter referred to as the ‘Decision’).

Pursuant to the content of the Decision made, the Court further decided:

1)  to appoint a judge of the District Court, Joanna Tuks, to the position of an official receiver;

2)  to appoint Janusz Kaźmierczak to the position of an administrator;

3)  to authorise the Debtor to carry out management of the entire company within a scope which does not exceed the scope of standard management;

4)  to specify that the competence of the District Court for Katowice - Wschód in Katowice results from the provision of Article 342 (1) of the Act dated 15 May 2015 –  the Restructuring Law ( Dz. U. [Dziennik Ustaw, Journal of Laws) of 2015, item 978, as amended), and that the proceedings shall constitute the primary restructuring proceedings.
