Signing the detailed agreement by the Subsidiary Company.

With reference to the current report no. 124/2012 of 19 December 2012, the Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (hereinafter referred to as the “Company”) informs that it obtained the information about signing on 19 March 2013 by Subsidiary Company Torpol S.A. an Agreement defining detailed scope of work of consortium partner PUT Intercor Sp. z o.o. and mutual settlements between the Consortium leader Torpol S.A with its registered office in Poznań and consortium partner PUT Intercor Sp. z o.o. with its registered office in Zawiercie in connection with the contract for the Design and execution of works for Modernization of railway line E75 Rail Baltica along the section Warsaw - Białystok - the border with Lithuania, the first stage, Warsaw - Rembertów - Zielonka - Tłuszcz (Sadowne) section.  

Terms and conditions of the Agreement:

net remuneration: PLN 184.357.429,06; gross remuneration: PLN 226.759.637,74 

Execution period: 33 months of the commencement date, i.e. of 20.12.2012.

The period of reporting defects is 60 months; 

The maximum amount of contractual penalties is 30% of the gross contract price; 

The value of the ISSUER’S equity capital has been assumed to be the criterion for considering the Contract to be material.
