Dismissal of bakruptcy petition of the Issuer’s Subsidiary Company.

With respect to current report no. 134/2012 of 28 December 2012, the Management Board of POLIMEX-MOSTOSTAL S.A. with its registered office in Warsaw (“the Company”) hereby informs that on 23 April 2013 Tubud Sp. z o.o. with its registered office in Płock, subsidiary to the Company (“the Subsidiary Company”) has received the decision of the District Court in Płock, V Commercial Division (“the Court”) on dismissal of petition for liquidation bankruptcy of the Subsidiary Company’s assets.

The petition has been dismissed by the Court due to the fact that the remaining assets of the Subsidiary Company, according to the conducted analysis of the factual circumstances as well as the value of the assets estimated by the Court, are not sufficient to cover the costs of bankruptcy proceedings thus, the dismissal of the petition for bankruptcy of the Subsidiary Company by the Court was legitimate.
