Supplementation of the petition of Eurometal S.A.

With reference to the current report no. 94/2012 of 12 October 2012, the Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw (“the Company’) at ul. Czackiego 15/17 informs that on 5 November 2012 it obtained the information about filing the missing attachment for the Company’s liquidation bankruptcy petition by Eurometal S.A. to the Commercial Department for Bankruptcy and Reorganization at the District Court for the capital city of Warsaw in Warsaw on 27 September 2012, and about which the Company informed in the aforementioned current report.

The Company maintains its stance that it perceives filling the abovementioned petition by the Eurometal Company S.A. solely as an element of the actions taken by the Eurometal Company S.A. due to its dispute with the Company concerning the amount of receivables owed to Eurometal Company S.A. for performed task commissioned by the Company. In the abovementioned dispute, the Company has paid the amount corresponding with disputed receivables to the escrow deposit, therefore securing any possible receivables of Eurometal S.A. In furtherance of the foregoing and the fact that the petition of Eurometal S.A. is unjustified, the Company has filed for dismissal of the Eurometal S.A. liquidation bankruptcy petition to the competent court.
