Signing of the performance bond contract by the Issuer’s Subsidiary Company

With reference to the current report no. 28/2013 of 6 March 2013, the Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (hereinafter referred to as the “Company”), hereby informs that it obtained the information about signing on 14 March 2013 of the contract for insurance performance bond as well as elimination of faults and defects of the contract for the design and execution of construction works as a part of the project “Quality improvement of the transportation services by improving the technical condition of the railway line no. 143 Kalety - Kluczbork section” by Torpol S.A. (hereinafter referred to as the “Subsidiary Company”) 

The contracting parties are:  

Generali Towarzystwo Ubezpieczeń S.A. (Guarantor), ul. Postępu 15B, 02-676 Warsaw,

TORPOL S.A., ul. Mogileńska 10G, 61-052 Poznań, 

PKP Polskie Linie Kolejowe S.A. (Beneficiary), ul. Targowa 74, 03-734 Warsaw; 

Terms and conditions of the Contract:

Sum guaranteed - with respect to performance bond: PLN 15,359,991.92,

                        - with respect to the faults and defects elimination: PLN 4,607,997.57,

 The term of the guarantee:

                        - with respect to performance bond: 12.05.2015,

                        - with respect to the faults and defects elimination: 03.06.2018; 

The value of the Company's equity capital has been assumed to be the criterion for considering the contract to be material.  

It is the second contract (current report of 19.12. 2012 no. 125/2012) which has been concluded by TORPOL S.A. with Generali Towarzystwo Ubezpieczeń S.A.
