Signing of an Agreement on granting a bank guarantee with Powszechna Kasa Oszczędności Bank Polski S.A.

The Management Board of Polimex -Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 informs that on 17 February 2012 it received an Agreement on granting a bank guarantee signed by Powszechna Kasa Oszczędności Bank Polski S.A. and the original bank guarantee regarding reimbursement of the advance money amounting to PLN 96,530,400, issued in favour of PGE Elektrownia Opole. The guarantee was issued upon the order of Polimex-Mostostal S.A. in connection with the signature of an Agreement No. 150/12, as amended, between PGE Elektrownia Opole S.A. and a group of companies comprising Rafako S.A., Polimex-Mostostal S.A. and Mostostal Warszawa S.A. regarding ‘Construction of power units nos. 5 and 6 at PGE Elektrownia Opole S.A., covering design, completion, testing, trials, delivery, installation and commissioning, i.e. ‘turn-key’ realisation of two power units for overcritical parameters, fuelled with hard coal dust, and auxiliary systems, of the gross output of 900 MW each, i.e. Power Unit 5 and Power Unit 6’.

The foregoing guarantee of reimbursement of the advance money constitutes 2% of the scope of an Agreement No. 150/12 realised by Polimex-Mostostal S.A. The guarantee expires on 15.02.2013.

Securities of the Agreement as well as the amount of other commissions and charges have been agreed upon on market terms.
