Selection of the bid "Design and construction of motorway A-2 Stryków-Konotopa along the section from km 394+500 to km 411+465,8"

The Management Board of Polimex-Mostostal S.A. informs that on 27 August 2009 r. it receivedinformation that the bid made by the following Consortium of companies was found to be the mostbeneficial:

The bid was submitted in the procedure for awarding a public procurement in the mode of closedtender entitled “Design and construction of A-2 motorway Stryków-Konotopa along the sectionfrom km 394+500 to km 411+465,8" – section B, conducted by Generalna Dyrekcja DrógKrajowych i Autostrad – General Directorate for National Roads and Motorways) (Employer).

Bid price:

Net price: 691.444.047,41 PLN -(say: six hundred and ninety one million four hundred and forty fourthousand forty seven and 41/100 PLN )

Gross price: 843.561.725,64 PLN – (say: eight hundred and forty three million five hundred and sixtyone thousand seven hundred and twenty five and 64/100 PLN ).

Participation of Polimex-Mostostal S.A. in the works and remuneration is to be: 49 % of total value.

Execution period : 32 months from the commencement date.

Under the applicable regulations, the procedure of selecting the said bid will undergo the inspectionby the Head of Public Procurement Division.

The Employer will notify the Contractor about the date of agreement conclusion and fulfillingformal issues connected with it – in a separate letter.

Pursuant to the provisions of the Act of 29 January 2004 „Public Procurement Law (hereinafter: PPLAct), Contractors and other persons are entitled to the legal protection means as defined in VolumeVI of this act, should there legal interest in receiving procurements has been or maybe harmed as theresult of breaching by Employer of the provisions of PPL Act.

The Contractor is entitled to file his protest within the period of 10 days from the date when hereceived or could have received notification about circumstances consisting the basis for filing theprotest.

The Employer will settle the protest under the rules defined in Article.183 of PPL Act.

Legal basis: Article 56 section 1 point 1 of the act on public offering and conditions for implementing financialinstruments to the organized system of turnover, and commercial companies in connection with § 5 section. 1 point 3 inconnection with §9 of the Regulation of Minister of Finances of 19 February 2009 on current and periodical informationsubmitted by the issuers of securities and the conditions of approving as equal the information required by the regulationsof a country that is not a member country (JoL of 2009 No. 33 item. 259).
