Royal Bank of Scotland performance bond claims

The Management Board of Polimex-Mostostal S.A. hereby informs that on 28.03.2013 it received the e-mail from RBS Bank (Polska) S.A. with the information that in connection with submitted by RBS (Romania) S.A. demand for payment of reguarantee issued by RBS Bank (Polska) S.A. for RBS Bank (Romania) S.A., the bank shall pay EUR 1.500.000 of the guarantee amount pursuant to the received demand of the said Bank.

By the order of Polimex-Mostostal S.A. the abovementioned reguarantee issued by RBS Bank (Polska) S.A. warranted the performance bond claims in the guarantee period by the Romanian Subsidiary Company Coifer Impex SRL issued by RBS Bank (Romania) S.A. for Nusco Tower SRL in relation to construction of office building in Bucharest. With respect to the performance bond claims submitted by Nusco to Coifer Impex SRL there is a dispute related to their compliance with the contract.

In the current report no. 58/2013 we informed on issuing of the decision by the Civil Court in Bucharest, on starting the bankruptcy procedure with the possibility of reconstruction of the Subsidiary Company Coifer Impex SRL with its registered office in Bucharest in Romania. The decision of the Court concerning the continuation of the procedure shall be taken on 06.09.2013.
