Receiving by the Company a guarantee of payment for construction works

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (the “Company”) informs of receiving by the Company on 10 January 2014 of two bank guarantees issued by order of the State Treasury - Generalny Dyrektor Dróg Krajowych i Autostrad (the General Directorate of National Roads and Motorways (“GDDKiA”). Bank guarantees assure the payment of remuneration of the total value of PLN 1,827,077,049.85.

The first guarantee was issued to the Company as well as Doprastav a.s., MSF Engenharia S.A. and MSF Polska sp. z o.o. as the beneficiaries at the amount of PLN 970,466,276.99 in order to assure timely payment of remuneration for the construction works (pursuant to Article 649 (1) of the Civil Code) performed on the basis of the contract dated 22 December 2010 titled: “Design and construction of the A1 motorway Stryków - “Tuszyn” junction along the section from 295 + 850 km (from “Stryków I” junction without the junction) to 335 + 937.65 km” valid no later than 18 January 2016. The second guarantee was issued to the Company and Doprastav a.s as the beneficiaries at the amount of PLN 856,610,772.86 in order to assure timely payment of remuneration for the construction works (pursuant to Article 649 (1) of the Civil Code) performed on the basis of the contract dated 23 September 2010 titled: “Construction of the A-4 motorway section, Rzeszów (Rzeszów Wschód junction) – Jarosław (Wierzbna junction) section from km 581 + 250 to km 622 + 450” valid no later than 10 July 2015. Both guarantees are conditional and revocable by GDDKiA.
