Receipt of the letter from GDDKiA

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (the “Company”) informs of:

1.     today’s receipt of the original of the letter from the State Treasury - Generalnego Dyrektora Dróg Krajowych i Autostrad (the General Directorate of National Roads and Motorways) (“GDDKiA”) (facsimile of the said letter was sent yesterday after the Company’s work time) on withdrawal by the GDDKiA from the contract dated 23 September 2010 regarding construction of the A-4 motorway section, Rzeszów (Rzeszów Wschód junction) – Jarosław (Wierzbna junction) section from km 581 + 250 to km 622 + 450 concluded with the consortium of Polimex-Mostostal S.A., Doprastav a.s.;

2.     today’s obtaining information on receipt of a facsimile (which was sent yesterday after the Company’s work time) comprising a letter about withdrawal by the GDDKiA from the contract dated 22 December 2010 regarding design and construction of the A1 motorway Stryków - "Tuszyn" junction along the section from 295 + 850 km (from "Stryków I" junction without the junction) to 335 + 937.65 km concluded with consortium of the companies: Polimex-Mostostal S.A., Doprastav a.s., MSF Engenharia S.A. and MSF Polska sp. z o.o.;

In the Company’s opinion, GDDKiA’s statements on withdrawal from the abovementioned contracts are groundless and do not bear any legal effects due to the fact that yesterday, i.e. 14 January 2014, the Company effectively withdrew from the abovementioned contracts in their entirety, of which the Issuer informed in the current report no. 4/2014.
