Petition of the Inwestycje Przemysłowe Sp. z o.o.

Current report no. 104/2012

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (“the Company”) informs that on 24 October 2012 the creditor of the Company – Inwestycje Przemysłowe Sp. z o.o. has filed the liquidation bankruptcy petition of the Company to the Commercial Department for Bankruptcy and Reorganization at the District Court for the capital city of Warsaw in Warsaw.

For the time being, there are no court proceedings pending in relation to receivables reported in the bankruptcy petition, and there has been no enforcement order issued. In the Company’s opinion, the bankruptcy petition of the Inwestycje Przemysłowe Sp. z o.o. is unjustified. The Company is planning to take legal actions aimed at dismissal of the said petition.
