Obtaining an order for payment by the Company

With reference to current report no. 21/2014 dated 5 February 2014, the Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (“the Company") informs that on 20 May 2014 the Company received an order for payment issued in writ-of- payment proceedings by the Regional Court in Warsaw, XXV Civil Division against the State Treasury - Generalny Dyrektor Dróg Krajowych i Autostrad (the General Director of National Roads and Motorways) with its registered office in Warsaw (“Order for payment”). Order for payment was issued with respect to the Company’s claim for the payment of contractual penalty regarding the contract dated 23 September 2010 for construction of a A4 motorway, section: Rzeszów (Rzeszów-Wschód junction) - Jarosław (Wierzbna junction) from 581 + 250 to 622 + 450.

According to the Order for payment, the State Treasury - the General Director of National Roads and Motorways is obliged to pay for the Company the amount of PLN 111,992.128 (PLN one hundred million nine hundred ninety two thousand and one hundred twenty eight) with the statutory interest from 4 February 2014 until the day of payment and until reimbursing the cost of proceedings, including the cost of legal representation.

The issued Order for payment is not binding. The State Treasury - the General Director of National Roads and Motorways is authorized to appeal against the order within 14 days of delivery of the Order for payment.
