Liquidation bankruptcy petition of Nixen sp. z o.o.

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw (“the Company’) at ul. Czackiego 15/17 informs that on 9 October it received the information about the fact that a creditor of the Company – Nixen sp. z o.o. with its registered office in Raszyn (hereinafter referred to as the ‘Creditor’) – filed with the District Court for the Capital City of Warsaw in Warsaw, X Commercial Division for Bankruptcy and Reorganization – a liquidation bankruptcy petition of the Company.

In the opinion of the Company, the amount due claimed by Nixen sp. z o.o. is disputable. To the best of Company’s knowledge, neither court proceedings are pending in relation to reported liquidation of receivables petition, nor enforcement title has been claimed.

The Company is planning to take legal actions aimed in particular at discontinuation of the bankruptcy petition proceedings.
