The dismissal of an appeal

Referring to current report no. 17/2015 of 27 January 2015, the Management Board of Polimex-Mostostal S.A. having its registered address in Warsaw (hereinafter referred to as the "Company") announces that it has obtained information that, under a decision of 23 August 2016, the Court of Appeal in Warsaw has dismissed the appeal of the claimant against a decision of the Regional Court in Warsaw to dismiss the action of the Polimex-Mostostal S.A., Metrostav a.s. and Doprastav a.s. Consortium concerning a contract on the construction of the Szarów-Brzesko section of the A4 Motorway against the Treasury represented by the General Director for National Roads and Motorways for payment of PLN 114,604,497.20 with statutory interest due to an increase in the remuneration of the construction contractor following changes in the scope of works introduced by the investor, taking into account substantial changes in the market prices of materials.

The decision of the Court of Appeal in Warsaw is legally binding.

After receiving a written justification and becoming familiar with the motives of the decision, the Company will take a decision concerning further steps and announce it in a current report.
