Confidential information – infringement of a material agreement

With reference to current report no. 92/2013 dated 29 June 2013 regarding infringement by Polimex-Mostostal S.A. (hereinafter referred to as the ‘Company’) of the terms of the agreement concluded with banks and bondholders (hereinafter referred to as the ‘Creditors’) specifying the terms of Company financing by the Creditors (hereinafter referred to as the ‘Agreement’), the Management Board of the Company informs that an annex to the Agreement, the purpose of which was, among others, the Creditors’ consent to the spreading into monthly installments of the interests provided for in current report no. 92/2013, has not entered into force due to one of the Creditors failing to sign the annex within time stipulated (i.e. by 1 July 2013).

The annex was signed by the Company and its subsidiary companies being a party to the Agreement as well as 30 out of 31 Creditors being a party to the Agreement.
