Request for payment of guarantee funds concerning the construction of the Europa Centralna Shopping Centre in Gliwice.

The Management Board of Polimex-Mostostal S.A. (“the Company”) informs that today, i.e. on 14 February 2013 it acquired information from BNP Paribas Bank Polska S.A. (“the Bank”) on receiving by the Bank on 12 February 2013 a request for payment of an amount of PLN 25,938,604.23 as performance bond issued by the Bank on the Company’s order on account of Helical Sośnica sp. z o.o. The subject guarantee has been issued according to completion of a contract for the ‘Construction of the Europa Centralna Shopping Centre in Gliwice’ (current report no. 64/2011 of 14 November 2011.) The guarantee has been valid until 12 February 2013.

 The request of Helical Sośnica Sp. z o. o. is currently a subject matter of the analysis performed by the BNP Paribas Bank Polska S.A. and the Company.

 At the same time the Company informs that the District Court in Warsaw, XX Commercial Division issued on 25 January 2013 a decision under which the Helical Sośnica sp. z o.o. was not allowed to exercise rights resulting from the subject guarantee issued by the Bank. This decision was delivered to the Helical Sośnica Sp. z o.o. on 31 January 2013.
