Claim for contractual penalties payment

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (“the Company”) informs with reference to the current report no. 18/2014 dated 1 February 2014 of filing on 14 February 2014 by the Company and the rest of consortium members, i.e. MSF Polska Sp. z o.o., MSF Engenharia SA, Doprastav a.s. (“Consortium members”) of a claim against the State Treasury - Generalna Dyrekcja Dróg Krajowych i Autostrad (the General Directorate of National Roads and Motorways) for payment of contractual penalties calculated with regard to withdrawal from the contract no. 4/12/R/2010 for design and construction of the A1 motorway Stryków - "Tuszyn" junction along the section from 290 + 850 km (from "Stryków I" junction without the junction) to 335 + 937.65 km (“the Contract”) due to the reasons attributable to Generalna Dyrekcja Dróg Krajowych i Autostrad. The value of the object of the claim filed by all Consortium members amounts to PLN 176,954,027, including the Company’s demand of the claim amounting to PLN 79,204,623.

In the Company’s opinion, filing a claim is legitimate because of the withdrawal by the Company from the Contract due to the reasons attributable to Generalna Dyrekcja Dróg Krajowych i Autostrad.
