Signing the intent letter

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (“the Company”) informs of signing on 6 May 2014 by the Company with the State Treasury - Generalnym Dyrektorem Dróg Krajowych i Autostrad (General Directorate for National Roads and Motorways - GDDKiA”) an intent letter related to the terms of cooperation and mutual settlement (“Intent letter”).

The Intent letter is connected with the dispute related to the counterclaims between the Company and GDDKiA, connected with performance of the following projects: (i)construction of the A1 motorway (Stryków - Tuszyn section), (ii) construction of S69 expressway (Mikuszowice - Żywiec section), (iii) construction of the A4 motorway Rzeszów Wschód – Jarosław section), (iv) construction of the A4 motorway (Szarów junction - Brzesko junction). The company and GDDKiA declared in particular: (i) the intention to cooperate with respect to settlement of the subcontractors, suppliers and service providers employed at the aforementioned projects, (ii) the intention to discuss amicable determination of the amount of the counterclaims.

The company also informs that the Intent letter does not have an obligatory nature and above all it may not constitute the basis for any claims and does not imply the waiver or assumption of any rights or claims.
