Conclusion of annex to material contract (Opole project).

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw (hereinafter referred to as “the Company”) informs that on 16 May 2013 it has concluded with PGE Górnictwo i Energetyka Konwencjonalna S.A. (formerly PGE Elektrownia Opole S.A.) (hereinafter referred to as “the Ordering Party”) and Rafako S.A. and Mostostal Warszawa S.A. acting jointly with the Company as Consortium (hereinafter jointly referred to as “General Contractor”) an annex to the contract for construction of power units nos. 5 and 6 in Elektrownia Opole dated 15 February 2012 (“Contract”); the Company informed about the conclusion thereof in current report no. 8/2012 dated 15 February 2012.

Pursuant to this annex, the Parties:

i.      in respect of concluded by the Ordering Party decision on closing the investment project “Projekt Opole II”, have set the principles of accounting for the costs incurred by the General Contractor with respect to the preparatory works related to execution of the Contract, and the reimbursement of the costs by the Ordering Party, 

ii.    have set the principles of procedure in the event of lack of reimbursement of the advance payment by the General Contractor received from the Ordering Party in a situations, when the General Contractor is obliged to reimburse such advance payment or the remaining part after the costs have been accounted for, as mentioned in item I above.

 iii.   have extended the period which specifies the possibility of issuing by the Ordering Party the notice of intention to order the commencement of works on this project from three months until the day of conclusion of annex.
