Confidential information - cessation of a material breach of Agreement

With reference to the current reports no. 75/2013 and 76/2013 of 1 June 2013 on the breach of Agreement specifying the terms and conditions of financing the Company by the creditors (hereinafter referred to as the ‘Agreement’), the Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw (hereinafter referred to as the ‘Company’) informs that on 20 June 2013 it received the consent of the financial creditors being the party to the Agreement for waiver of rights arising form occurrence of breach of the Agreement consisting in failure to reach total revenues for issuance of series N1, N2 and O in the total amount of PLN 250 million and failure to conclude by the company the Annexes to selected construction contracts in the period specified by the Agreement i.e. until 31 May 2013. At the same time the Company is obliged by its creditors to execute the above obligations until 30 June 2013. As of the date of this report, the breach of Agreement of which the Company informed by current report no. 72/2013 of 29 May 2013 is continuing.
