seizure of property rights due to the Company to secure claims provided for in yet to become valid order for payment

The Management Board of Polimex-Mostostal S.A. (hereinafter referred to as the ‘Company’) hereby informs that on 26 August 2013 it was informed of a court executive officer seizing property rights (interests and profits) due to the Company in the following companies: (i) ‘ENERGOP’ sp. z o. o., (ii) Centrum Projektowe Polimex-Mostostal sp. z o.o., (iii) Przedsiębiorstwo Robót Inżynieryjnych ‘PRINŻ-1’ sp. z o.o., (iv) ‘Energomontaż-Północ – Technika Spawalnicza i Laboratorium’ sp. z o.o., (v) Pracownia Wodno-Chemiczna Ekonomia sp. z o.o.

The seizures were performed upon the request of IMTECH Polska sp. z o.o. with its registered office in Warsaw in order to secure claims regarding payment of the amount due totalling: PLN 1,827,843.10. The claims secured have been provided for in six yet to become legally valid orders for payment which were issued in dunning proceedings by the Regional Court in Warsaw which the Company defended within time stipulated.

In the opinion of the Company, the amount due claimed by IMTECH POLSKA sp. z o.o. is disputable and has been deducted from receivables due to the Company from IMTECH POLSKA sp. z o.o. due to charged contractual penalties. Today, the Company has sent to the Court – pursuant to Article 492 § 2 of the Code of Civil Procedure – six motions for a reduction of the security and reversal of the seizures performed by the court executive officer.
