Creditors’ consent to postpone the deadline for performance of certain obligations

With reference to current report no. 107/2013 of 1 August 2013 on the consent to postpone the deadline for performance of certain obligations by Polimex-Mostostal S.A. with its registered office in Warsaw (hereinafter referred to as the ‘Company’) arising from the agreement (hereinafter referred to as the ‘Agreement’) specifying terms and conditions of financing the Company by banks and bondholders being a party to the Agreement (hereinafter referred to as the ‘Creditors’), the Management Board of the Company informs that on 30 August 2013 it was notified about the fact of granting the Company the consent of the Creditors for waiver of rights arising from occurrence of breach of the Agreement involving (i) failure to reach total revenues for issuance of series N1, N2 and O shares in the total amount of PLN 250 million and (ii) failure to conclude by the Company annexes to selected construction contracts in the period specified by the Creditors, i.e. until 31 August 2013. The Company was obliged by the Creditors to perform the aforementioned obligations until 30 September 2013.
