Creditors’ consent to the postponement of the deadline for the performance of certain obligations

With reference to current report no. 117/2013 dated 30 August 2013 with respect to consent to the postponement of the deadline for Polimex-Mostostal S.A. with its registered office in Warsaw (hereinafter referred to as the ‘Company’) to perform some of its obligations provided for in an agreement (hereinafter referred to as the ‘Agreement’) specifying the terms of Company funding by banks and bond holders being a party to the Agreement (hereinafter referred to as ‘Creditors’), the Management Board of the Company hereby informs that on 30 September 2013 they received the information that the Company had received the Creditors’ consent to waive their rights resulting from a breach of the Agreement involving (i) failure to obtain total proceeds from the issues of series N1, N2 and O shares totalling PLN 250 million, and (ii) Company’s failure to enter into annexes to selected construction contracts within the time stipulated by the Creditors, i.e. by 31 September 2013. The Company was obligated by the Creditors to fulfil the aforementioned obligations by 31 October 2013.
