Initiation of proceedings and order for payment

The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Czackiego 15/17 (hereinafter referred to as the “Company”) informs that on 8 October 2013 the Company received an order for payment issued in dunning proceedings on 26 September 2013 by the Regional Court in Cracow.

The order was issued against the Company and Doprastav a.s. in Bratislava as joint and several debtors regarding the payment of the amount due totalling PLN 18,317,524.08 plus the statutory interest and the court fees (the value of the object of litigation) to SUPER-KRUSZ Sp. z o.o. as a plaintiff.

The content of the lawsuit attached to the order for payment implies that the court proceedings against the Company were initiated on 10 September 2013. The plaintiff seeks payment for the conditional aggregate sale contract concluded on 17 January 2012.

Presently, the Company analyses the legitimacy of the said order and does not exclude defending action regarding the order for payment.
