Order for payment to the benefit of the Issuer

With reference to current report no. 121/2014 dated 14.08.2014, and to current report no. 149/2014/K dated 03.10.2014,The Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Młynarska 42 (“the Company”, “the Issuer”) informs that yesterday a claim was filed with the Regional Court in Warsaw XXV Civil Division in proceedings by writ of payment against the State Treasury - General Director of National Roads and Motorways with its registered office in Warsaw ("the Defendant") for payment of remuneration for construction works performed as part of the agreement no. 2811/45/2010 on the performance of works consisting in the construction of the A-4 motorway, section Rzeszów (Rzeszów-Wschód junction) – Jarosław (Wierzbna junction), from km 581 + 250 to km 622 + 450 ("the Contract").The initiation of the proceedings is a result of failure to make payment for the performance of construction works. The value of the object of litigation amounts to PLN 59,866,305 with statutory interest from 30 October 2014 until the date of payment.

In Company’s opinion, the claim is reasonable, since the object of the claim is demand for payment of the remuneration for the performed construction works.
