Confidential information – Receipt of a demand for payment under guarantee

With reference to current report no. 170/2013 dated 26 November 2013, the Management Board of Polimex-Mostostal S.A. with the registered office in Warsaw (hereinafter referred to as the "Company") hereby informs that on 4 December 2013 it was notified by Towarzystwo Ubezpieczeń i Reasekuracji "WARTA" S.A. (hereinafter referred to as the "Guarantor") of the receipt by the Insurer from Stadion w Zabrzu Sp. z o.o. with the registered office in Zabrze (hereinafter referred to as the "Beneficiary") of a demand for payment of the amount of PLN 19,249,985.30 under a guarantee regarding the performance of the contract no. 2011/99 dated 24 August 2011 regarding "Modernization of the Ernest Pohl Stadium in Zabrze - Stage I" (hereinafter referred to as the "Contract"), issued by the Guarantor. The demand is currently being analysed form the legal and formal point by the Guarantor. In the opinion of the Company, the Beneficiary has been abusing its rights under the held performance bond. Should undertaken steps not result in abandonment of the claim, the Company is ready to take all measures in order to protect its interests, including undertaking legal proceedings.
