Decision on securing the Issuer’s claims

In relation to the current report no. 148/2014 and the current report no. 188/2014, the Management Board of Polimex-Mostostal S.A. with its registered office in Warsaw at ul. Młynarska 42 (“Company”, “Issuer”, “Plaintiff”) hereby informs that the District Court in Kraków, IX Commercial Division has issued a decision in the case file ref.: IX GC 955/14 referring to negative declaration of the right Zakłady Budowy Maszyn i Aparatury im. Ludwika Zieleniewskiego S.A. in Kraków (“Defendant”) to demand that the Company pays PLN 898 662.60 as a contractual penalty calculated due to the fact that the Company has not left the subject of the lease agreement concluded between the parties on 23 May 2007. By means of the indicated resolution, the court has secured the Company’s claim by ordering the Defendant to withdraw the bankruptcy petition filed by the Defendant with the District Court for the Capital City of Warsaw in Warsaw, X Commercial Division for Bankruptcy and Reorganization and by forbidding the Defendant to file such a petition until the completion of proceedings. The court has made the execution of the decision on granting security conditional upon the provision of a deposit by the Plaintiff to secure the Defendant’s claims arising from the execution of the decision on security in the amount of the claim contested by the Plaintiff.
