Dismissal of an action.

The Management Board of Polimex-Mostostal S.A. having its registered office in Warsaw hereby informs that in the verdict dated 03.09.2015 the District Court in Warsaw, XXV Civil Law Division (file ref. no. XXV C 857/12) dismissed that action of 3 June 2012 brought by a consortium of the following companies: Mostostal Warszawa S.A., Acciona Infraestructuras S.A. and Polimex-Mostostal S.A. against the State Treasury – the General Director of the National Roads and Motorways. The action regarded determination of the legal relation and payment of the amount of PLN 36,961,661.00, inclusive of interest, due to the increase of the prices of fuels and asphalts in relation to the contract entered into on 28 September 2009 for the design and construction of the Stryków-Konotopa A2 motorway section from km 394+500 to km 411+465,8.

Moreover, the Court adjudicated that the complaining parties jointly and severally pay the amounts of PLN 7,200.00 to the State Treasury as reimbursement of the costs of proceedings.

The verdict is yet to be legally binding.
