Information on the construction of the Ernest Pohl stadium in Zabrze

As a result of the need to make changes to the design documents, which were the result of adaptive changes reported by the Employer - Stadium in Zabrze Limited liability company – aimed at optimizing the functionality of the object, Polimex-Mostostal was forced to slow down or halt some construction work in anticipation of the project documentation provided by the Employer.

 

Polimex-Mostostal repeatedly kept on informing the Employer about shortcomings and errors in the design documentation for the various stages necessary to carry out the work.

We also paid attention to the delay in acceptance of material requests by the Employer (e.g. on the roof of polycarbonate), making it impossible for the contractor to order boards and start mounting the roof). Delays are as long as a few months.

The Employer also took decisions on the suspension of certain works in connection with the need to provide for replacement designs, which Polimex-Mostostal has not received and, as a result, could not continue construction.

In turn, another decision of the Employer, on the exclusion of certain works from the scope of the order, meant that, as a result, it was not possible for Polimex-Mostostal to execute works related to finishing, cladding, flooring, installation and others.

Another decision of the Employer, concerning the interruption of the heating system execution, caused the fact that the stadium premises are not heated, making it impossible to continue to work in the winter.

 

The Employer withdrew from the agreement and called Polimex-Mostostal to pay liquidated damages.

 

In the opinion of Polimex-Mostostal, the Employer has no grounds to do so. Polimex-Mostostal will now be analyzing the situation, formally and as a result, will take appropriate action.
