Elektron-Inwestycje company acted in bad faith

Elektron-Inwestycje admitted to have acted in bad faith when applying for declaring Polimex-Mostostal bankrupt.

"Elektron-Inwestycje Sp. z o.o. with its registered office in Świętochłowice represents and admits that its application to the District Court for the capital city of Warsaw to declare Polimex Mostostal S.A. bankrupt was filed in bad faith and was groundless" - reads the statement published in "Puls Biznesu" daily.

Due to the absence of the title to bring the action before the court, in January 2015 the District Court for the capital city of Warsaw dismissed the case brought by Elektron-Inwestycje Sp. z o.o. with its registered office in Świętochłowice to declare Polimex-Mostostal bankrupt. The court at that time ordered that Elektron-Inwestycje Sp. z o.o. publish in a nationwide, daily newspaper a statement in which it should admit to have acted in bad faith and had no grounds for applying for PxM bankruptcy. Moreover, the court ruled that the legal fees including the costs of legal representation be paid by the applicant to Polimex-Mostostal S.A.
